1. WHEREAS
the First Party (Robert SMK. Silitonga) is a duly
licensed employment agent in Jakarta, Indonesia and
wishes to appoint the Second Party (....................)
as his employment agent in Singapore/Malaysia/Hong Kong
/
Brunei to secure jobs for
housemaids from Indonesia.
2. The
First Party and Second Party hereby agree that this
Memorandum of Agreement will serve as a broad outline of
their intentions to co-operate and do
business together and that if necessary, this Memorandum
of Agreement may
be supplemented and amended by a formal
written Contract at a subsequent date.
3.
DUTIES AND RESPONSIBILITIES OF THE FIRST
PARTY
·
To send personal particulars including
the photographs of prospective housemaids and health
records to the
Second Party in order that the
Second Party may offer the housemaid to prospective
employers for employment,
with them on a two years contract.
The First Party will ensure that he
will attend to all formalities and documentation in
compliance with the
rules and laws regarding the export
of housemaid in Indonesia.
The First Party having assured that
all the formalities and documentation have been
complied with shall
then upon request by the Second
Party send the prospective housemaid to Singapore.
The agency fee to be paid by the
Second Party to the First Party S$.

.............Singapore Dollars). The facilities and
expenses necessary for the departure of the
housemaid including airfares, medical expenses, fees
for passport of the Republic of Indonesia, will be
responsibility of the First Party.
4. DUTIES
AND RESPONSIBILITIES OF THE SECOND PARTY
The Second Party is responsible for
the acknowledgment of an employment agreement
between the
employer and the housemaid to the
Embassy in Singapore/Malaysia/Hong Kong /
Brunei (Consular
Section).
The Second Party shall be responsible
to supervise the welfare of the housemaid while she
is in Singapore
and until the date her agreement
ends. Hence, the employer shall be responsible for
the housemaids
welfare, but the Second Party will
still do the monitoring.
In the event where there is a dispute
between the housemaid and her employer, the Second
Party
undertakes to accommodate the
housemaid with adequate food, lodging and medical
assistance as and
when needed.
The Second Party further undertakes
to seek alternate employment for any rejected
housemaid in the event
where the ex-employer decides to
cancel her working visa without justified reasons
and human cause. The
Second Party shall seek the
assistance from the Indonesian Consular Section and
the Labour standard of
the Ministry of Manpower in
Singapore.
The Second Party has to transfer to
the bank accounts of the First Party at HSBC
Singapore, A/C No.: 142-
131937-060 on behalf of Robert
SMK. Silitonga of each found that who is fit to
work within 3 (three)
calendar days and fax the payment
slip to Jakarta.
5. THE
FIRST PARTY UNDERTAKES TO GUARANTEE THAT THE
HOUSEMAID IS
:
Obedient to Employer.
Hardworking and responsible.
Knows how to do housekeeping.
The housemaid must be certified
healthy and fit to work prior to arrival in
Singapore/Malaysia/Hong
Kong/Brunei
The term of contract is on two (2)
years basis but it can be extended provided it is
agreed by both parties
(Employer & Housemaid).
If within three (3) months since the
arrival of the housemaid, the housemaid cannot
perform her duties
because of certain reason that make
her impossible to perform her duties, the First
Party should find a
free replacement to the Second Party.
6.
MONTHLY SALARY/ WAGES
The salary of the housemaid is S$.
........ - S$. ........ / month / person with 1
off-day (be exchanged to
S$. 10.00)/month.
The salary deduction is eight (...)
months salary (S$. ............).
The employer shall also assist the
housemaid in the opening of a saving account for his
/ her housemaid
under solely the name of the
housemaid.
In the event that any housemaid has
to be repatriated back home, the
Employer/Agent/Second Party has to
send the housemaid back to Jakarta by
air.
7.
WORKING
HOURS
·
The working hours is eight (8) hours /
day.
·
The employer shall ensure that the
housemaid is given at least a continuous period of eight
(8) hours sleeping time.
Adequate rest shall be also provided
during the day.
8. DAY OFF
Frequency of the housemaids day off
shall be one day of in every week and shall be paid
day off and
should the employer requires the
housemaid to work during her days off, an additional
compensation of
S$. 10.00 shall be given on top of
her basic salary for each day-off forgone by the
housemaid.
9. DUTIES
AND RESPONSIBILITIES OF THE EMPLOYER
The employer shall at all times treat
the housemaid in a just and humane manner. The
employer shall
further undertake to create
harmonious relations and working conditions, which
are conductive to good
Employer Employee relationship and
should not physically abuse the housemaid.
10.
SPECIAL PROVISIONS
In the event where the housemaid has
diligently completed her two years contracted period
and wishes to
continue for another two years
period, she is entitled to a CASH REIMBURSEMENT for
the cost of an air
ticket round trip,

The housemaid shall work exclusively
for the employer and his / her immediate household.
The employer
shall in no case require the
housemaid to work in another residence or at his /
her business
establishment.

Employment Agency
who recruits the housemaid shall
monitor the employment status of the
housemaid and provide back up service
to the employer with the view of ensuring harmonious
employment relationship.
The employer shall provide the
housemaid with Personal Accident Insurance Coverage
for the amount of
not less than S$. 5,000.00 for the
duration of the contract of employment at no cost to
the housemaid.
Additionally, the Employer shall
provide free medical and hospitalisation in case of
illness and their
levies as required by the Singapore
Government.
In the event any housemaid faced
accident or death, the Second Party has to inform
the First Party of the
incident and arrange to repatriation
of the deceased and all of her belongings and unpaid
salary as well
as balance of assurance (if any) and
hand them over to the next of kin of the deceased.

No further Clause shall be included in
this Memorandum of Agreement other than the above
mentioned unless otherwise agreed.

* 12 I / We undertake to abide by the
recruitment rules and procedures of the Indonesian
Embassy in Singapore at all times, including obtaining
an Embassy Approval Letter from the Embassy for every
housemaid that is to be deployed to Singapore for
employment.
