Employment Contract

 

 

EMPLOYMENT CONTRACT

 

 

This agreement made on the……..day of……….2010, between ............................. with address in .............................., (hereinafter called the Company) of the one part and Mr. …………………………………… holder of passport bearing no…………………….

Of (address) ……………………………………………………………………………………………………………………………………………….

(Hereinafter called the Employee), of the other part, under the following terms and conditions:

 

01.  Post

       The Company engages the Employee, and the Employee agrees to serve the Company as        skilled/unskilled workman in the position of ……………………………………………………………………….        (CATEGORY / TRADE) or any other such capacity as may from time to time be determined by the Company. During the employment period the Employee agrees to perform all Legitimate duties assigned to him by this Company or by any other person duly authorized to do so by the Company.

 

02.  LOCATION

        Any place in the Kingdom of Saudi Arabia where the Employee’s services may be required by the company.

 

03.  PERIOD OF CONTRACT

       This agreement becomes affective on the date of its signature, and continues for an indefinite period of time, until terminated by either party giving the other prior notice in accordance with the Company’s regulations and the provisions of the Labor Law of the Kingdom of Saudi Arabia.

 

04.  PROBATIONARY PERIOD

       It is expressly understood that the first six months will be probationary period during which the Company has the right to terminate this contract of service without prior notice or obligation.

 

05.  EMOLUMENTS

During the period of employment in the Kingdom of Saudi Arabia, the Employee shall receive a consolidated wages of Saudi Arabia Riyals (Daily Rate) ………… per working day inclusive of allowances applicable in the Kingdom of Saudi Arabia. The Employee will be required to work eight hours a day, six days per week and will be given a weekly day of rest.

   

06.  OVERTIME

If however the Employee is called upon to render work beyond the normal working hour, overtime will be paid in accordance with the existing Labor Law of the Kingdom of Saudi Arabia.

  

07.   MESSING

        The Company shall provide the Employee free food during the course of his employment.

  

08.   ACCOMMODATION

        The Company shall provide the Employee free of charge dormitory type of accommodation with communal ablutions.

 

09.   PASSAGE ENTITLEMENT

(i)   The Company shall provide the Employee with a single return passage from Doha to the place of embarkation on satisfactory completion of the assignment. The class of travel and the carrier will be decided at the sole discretion of the Company.

 

(ii)   However upon successful completion of 730 days of the Company shall provide the Employee with a y/e class air ticket between port of embarkation …………………………………  and ……….. The class of travel and the carrier will be decided at the sole discretion of the     Company. it is to be understood that this may be amended by the Company at any time in the light of changing circumstances. It should be noted that this may be adjusted by the Company depending on the exigency of work.

 

(iii) In the event of an emergency of any nature the Employee has option to travel at his own expense after obtaining the required approvals of the concerned project Managements to proceed on paid/unpaid leave. All expenses incurred will be borne by the Employee.

 

10.  MEDICARE

The Company shall provide the Employee free first aid facilities at work place make adequate arrangements to evacuate the injured for medical treatment in the event of accident at government clinics/Hospital. It should be noted that in the Kingdom of Saudi Arabia medical by the government free of charge.

 

11.  ANNUAL LEAVE

Will be paid in accordance with the existing Labor Law of the Kingdom of Saudi Arabia.

 

12.  TRANSPORTATION

Transportation of the Employee from Camp to work place and back shall be providing by the Company.

 

13.  TERMINATION / RESIGNATION

This agreement can be terminated by either party by giving the order 7/14 days notice in writing or notice pay consisting of basic wages regerred in Clause(5) herein in lieu of notice. In the event of terminating employment without notice, either party shall pay to the other a sum of equivalent to 7/14 days wages consisting of basic salary referred In to clause (5) in lieu of notice. If this occurs at the option of Employee then the cost of air ticket will be at this own expense and the Company has the right to repatriate the Employee’s entitlements with the Company.

  

14.  TERMINATION OF EMPLOYMENT WITHOUT BENEFITS

The Company reserves the right to terminate the employment and to repatriate the Employee at any time during the letters service without any compensation whatsoever regardless of the terms of agreement if the Employee:

 

(a)   Is found unsuitable for service in the Kingdom of Saudi Arabia.

(b)   Is found guilty of misconduct and improper behavior.

(c)   Fails to maintain normal productivity.

(d)   Disregards the rule and regulations in force, either at work place or residential camp.

(e)   Violates laws and customs of the Country.

(f)    Contravenes any of the conditions of the employment agreement.

(g)   Abstaining from duty without obtaining prior written permission of the concerned Project Management.

(h)   On striking work of inciting others to strike work.

(i)    Fails to carry out the instructions given by supervisors.

(j)    Fails to comply with the safety regulations resulting in damage and loss to Company property due to the negligence of his part, and he shall not be eligible for the return passage by the Company.

 

15.  GENERAL

This agreement constitutes a totally new and independent employment with the Company and shall not be deemed to be a continuation of any previous services rendered by the Employee to the Company  and/or its branches, associates, affiliates, subsidiaries, at any time In the past.

 

This agreement supersedes and cancels any and all previous agreements between the Company and the Employee whether written or oral.

 

Other terms not covered under this agreement will be in accordance with the Labor Law of the Kingdom of Saudi Arabia.
